Welcome to Driving You Nomad! By using our website, buying our travel guides and other digital products, or joining our tours, you agree to comply with and be bound by the following terms and conditions. Please read them carefully.

These Terms & Conditions apply to all services offered under the brand Driving You Nomad (www.drivingyounomad.com), including but not limited to group travel experiences promoted as Nomad Group Trips.

1. Definitions

In these Terms & Conditions, the following words have the meanings given to them:

  • “Company”, “we”, “us” or “our” refers to Driving You Nomad, the business operated by Delphine Libbrecht.
  • “Client”, “you” or “Traveller” refers to the person using our website, purchasing products, or booking a tour.
  • “Contract” means the agreement between you and us which includes these Terms & Conditions, the booking form (if applicable), and any other relevant documents.
  • “Tour” means any group travel or adventure tour organized and/or hosted by Driving You Nomad.
  • “Products” means travel guides, digital downloads, tours or any other products sold via our website.
  • “Unforeseen Event” means events outside the reasonable control of either party, such as natural disasters, pandemics, government restrictions, etc.

Any reference to ““we”, “us”, or “our” refers to Driving You Nomad, which operates and manages Nomad Group Trips as part of its services.

2. Use of Website and Intellectual Property

  • By accessing and using our website, you agree to be bound by these Terms & Conditions.
  • All content on our website, including but not limited to text, images, logos, videos, and guides, are owned by Driving You Nomad and protected by copyright and intellectual property laws.
  • You may not copy, reproduce, distribute, or publicly display any part of our content without explicit written permission.
  • We reserve the right to modify or terminate any part of the website or services without prior notice.

  • Communication by email is considered “in writing” for the purposes of these Terms.

4. Booking and Purchase Contract

For tours & group trips:

  • A binding contract is formed once your deposit is successfully paid and we send you a confirmation email.
  • A non-refundable deposit is required at the time of booking to secure your place.
  • Refunds (minus the deposit) are only available according to the specific refund and cancellation policy for each trip, which will be clearly stated in the trip details.
  • We reserve the right to cancel your booking at our sole discretion, in which case we will notify you as soon as possible and refund your deposit.

For digital products (e.g., travel guides, courses, downloads):

  • The sale is final once your purchase is confirmed and the product is made available for download or access.
  • No refunds are provided, except if the product is faulty or not delivered.
  • Due to the nature of digital products, returns or cancellations after access is granted are not accepted.
  • If you encounter any technical issues or have questions, please contact us for assistance.

5. Payment and Refunds

Tours & Group Trips:

  • A non-refundable deposit is required to secure your booking. The exact amount and payment deadlines will be specified for each trip.
  • The remaining balance is due no later than [a specified number of days, e.g. 60] days before the start date of the trip. Specific deadlines will be communicated per trip.
  • Failure to pay the balance by the deadline may result in cancellation of your booking without refund of the deposit.
  • Cancellation by you:
    • If cancelled more than [X] days before the trip start date, a refund of the paid balance (minus the deposit) may be issued.
    • If cancelled less than [X] days before the trip start date, no refund will be given.
  • We reserve the right to cancel any trip if minimum participant numbers are not met; in such cases, full refunds (including deposit) will be provided.

Digital Products (e.g., travel guides, courses):

  • Digital products are non-refundable once downloaded or accessed.

6. Passport, Visas and Insurances

  • Driving You Nomad (and in extent services offered Nomad Group Trips) does not provide insurance, visas, or flights. It is your responsibility to obtain and maintain all necessary travel documents, visas, vaccinations, insurance and flights.
  • We strongly recommend comprehensive travel insurance covering medical emergencies or other unforeseen circumstances.

We will make reasonable efforts to assist you with your visa applications to help ensure smooth travel with us. However, it is ultimately your responsibility to secure all necessary visas prior to the Departure Date.

You are responsible for obtaining all required vaccinations, medical documents, health clearances, passports, or equivalent identification before the Departure Date. We are not responsible for any issues related to your insurance, visa, or flight arrangements that may prevent you from participating in the tour.

7. Health and Participation

  • Participants must be at least 18 years old at the start of the tour.
  • You must be physically fit and capable of participating in the planned activities.
  • Please disclose any relevant medical conditions or dietary requirements at the time of booking.
  • We reserve the right to refuse participation or remove any participant whose behavior is unsafe or disruptive.

8. Changes and Cancellations by us

  • We may need to make changes to the itinerary or services due to Unforeseen Events.
  • If we cancel a tour for reasons within our control, you will receive a full refund.
  • If cancellation is due to external factors beyond our control (e.g., government advice, natural disasters, pandemics, political unrest, or other force majeure events,…), we are not liable for refunds or additional costs. In these situations, you must contact your travel insurance provider to seek reimbursement.
  • We are not responsible for any additional expenses you may incur due to changes or cancellations, such as flight or accommodation costs.
  • We will notify you as soon as possible in case of significant changes or cancellations.
  • We will set a minimum number of travellers required for the Tour to proceed. If this minimum is not met, you will be informed at least 30 days before the Departure Date that the Tour has been cancelled. In such cases, all payments made to us will be fully refunded.
  • We will provide the Tour itinerary before the Departure Date. Due to the nature of tours, some flexibility is required, and the itinerary (including timings, routes, or transport) may change due to unforeseen circumstances.

9. Liability

  • We do not accept liability for personal injury, loss, or damage during tours or use of our products.
  • You are responsible for your own safety, health, and belongings at all times.

10. Insurance

We do not provide (travel) insurance. It is your responsibility to arrange and maintain adequate and appropriate insurance before your trip. This should include:

  • Cancellation coverage
  • Medical expenses and repatriation
  • Liability insurance
  • Coverage for loss, damage, or theft of baggage

Please ensure your insurance is valid for the region you will be traveling to and covers medical expenses, medical emergencies and evacuation.

You must provide us with a copy of your current insurance policy before the Departure Date, and also present it to the tour leader upon arrival. Without valid insurance, we reserve the right to deny your participation in the tour without refund.

Your insurance should cover the entire duration of the tour, plus at least one additional day to cover any unforeseen changes to the itinerary.

11. Acceptance of Risk

You acknowledge and accept that travelling on a tour involves certain inherent risks. By agreeing to these Terms & Conditions, you accept our liability limitations as reasonable and fair.

We reserve the right to request a doctor’s certificate at any time to confirm that you are medically fit to participate in the tour.

Upon acceptance of your booking, you agree to sign our ‘Travel Risk Acknowledgement and Waiver’ form.

12. Company Tour Leader(s)

Each tour will be led by an appointed Tour Leader(s) who acts on our behalf during the trip. They are responsible for making decisions that ensure the smooth operation of the Tour and the wellbeing of the group.

By joining one of our trips, you agree to respect the authority and final decisions of the Tour Leader at all times. These decisions are always made with the best interest of the group in mind.

If, in the opinion of the Tour Leader, your health, behaviour, or actions negatively affect the group experience or your own safety, we reserve the right to remove you from the Tour. In such cases, no refund or compensation will be provided.

13. Legal Compliance

While travelling with us, you are expected to comply with all local laws and regulations of the countries you visit. This includes visa requirements, immigration rules, customs, and currency regulations — all of which are your responsibility.

If you fail to follow these laws or breach any part of this agreement, we reserve the right to remove you from the Tour without refund or compensation.

14. Complaints

  • If you have a complaint, please contact us promptly at hello@drivingyounomad.com.
  • We will make reasonable efforts to resolve any issues quickly and fairly.

15. Privacy

  • We handle your personal information according to our Privacy Policy.
  • We will not share your details with third parties except as required by law.

16. Governing Law

  • These Terms & Conditions are governed by the laws of Belgium.
  • Any disputes will be subject to the exclusive jurisdiction of Belgian courts.

17. Changes of These Terms

  • We reserve the right to update or modify these Terms & Conditions at any time.
  • Changes will be posted on this page with an updated date.
  • By continuing to use our services or website, you agree to any updated terms.
  • By booking a tour with Driving You Nomad (and in extent with Nomad Group Trips), you acknowledge that you have read, understood, and agree to these terms and conditions.
